The Kmart in Tulare isn’t the newest or biggest store in the retail chain. But a lawsuit filed on behalf of 65 current and former cashiers there could change the way California retail stores and other businesses operate. The lawsuit centers on whether the department store violated a little-known California labor rule requiring employers to provide chairs or stools for workers “when the nature of the work reasonably permits the use of seats.”
